Terms of Service

These terms are an agreement between you and FuelPing LLC, an Oklahoma limited liability company ("FuelPing," "we," "us"), covering your use of the FuelPing mobile application (the "App"). By purchasing or using the App, you agree to these terms.
1. What FuelPing is
FuelPing provides informational estimates about fuel price trends, notifications about expected fuel price changes, and directory information about nearby fuel stations and electric vehicle charging locations. It is an information convenience tool.
2. Your license
When you purchase the App, we grant you a personal, non-exclusive, non-transferable license to use it on devices you own, subject to the app store's standard terms. The purchase is a one-time fee; no subscription is required for the App's core features as described at purchase.
3. Purchases and refunds
Purchases are processed by Apple's App Store or Google Play, which act as merchant of record. Refund requests are handled through the respective store under its refund policies, not by us directly.
4. Predictions are estimates, not promises
The App's alerts and price information are automated estimates generated from public market data and news signals. Fuel prices are set by market forces and individual retailers, and no one can predict them with certainty. We make no guarantee that any prediction, price, date, magnitude, station listing, or charger listing is accurate, complete, or timely. Displayed prices may be regional averages rather than prices at a specific station, and are labeled accordingly in the App.
5. No reliance; your decisions are yours
The App's information is provided for general convenience only. It is not financial, commercial, or professional advice. You are solely responsible for decisions you make (including when and where to purchase fuel), and you agree not to rely on the App as your sole basis for any decision involving money, travel, or safety.
6. Service availability
We aim to keep the App and its alert service running continuously, but we do not guarantee uninterrupted availability, delivery of any particular notification, or continued operation of any feature. Push notification delivery also depends on Apple, Google, your device settings, and your network, none of which we control. We may modify, suspend, or discontinue the service (in whole or part) at any time.
7. Acceptable use
You agree not to reverse engineer, resell, scrape, or interfere with the App or its backend services, and not to use the App in violation of any law.
8. Disclaimer of warranties
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUELPING LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MONEY, SAVINGS, FUEL COSTS, PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE APP, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE APP IS LIMITED TO THE AMOUNT YOU PAID US FOR THE APP. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
10. Indemnity
You agree to indemnify FuelPing LLC against claims arising from your misuse of the App or violation of these terms.
11. Governing law and disputes
These terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Tulsa County, Oklahoma, and you consent to their jurisdiction. Either party may instead pursue an eligible claim in small claims court.
12. Changes to these terms
We may update these terms; the current version always lives at fuelpingapp.com/terms with its effective date. Continued use of the App after changes take effect constitutes acceptance.
